Reporting Claims of Copyright Violation
Beyondsmartcities.in‘s content is generated by its users (UGC). Beyond Smart Cities does not examine user-uploaded or user-generated content for copyright or other rights violations. If you believe that any of the uploaded content violates your copyright or a related exclusive right, however, you should follow the procedure outlined below. Beyond Smart Cities investigates reported violations and removes or disables content that is determined to violate the rights of third parties.
The following information must be included in a copyright infringement notice (the “Notice”) so that we can review your report efficiently:
- Describe your protected work and what is protected by the copyright(s) in question.
- Your copyright certificate(s) or designation(s) and the type, such as registered or unregistered, are required.
- Copyright evidence, including the registration number or a copy of the registration certificate
- a concise explanation of how our user(s) allegedly violate your intellectual property.
- Clear reference to the infringing materials that you want removed, such as the Specialist® url or a link to the deliverable provided to the user, etc.
- Your complete name, address, and telephone number are required.
- a statement that you have a good faith belief that the copyright owner, its agent, or the law does not authorise the material’s use in the manner in question.
- a statement made under penalty of perjury that the information provided in the notice is accurate and that you are the copyright owner or the owner of an exclusive right that is being infringed upon, or that you are authorised to make the complaint on behalf of the copyright owner or the owner of an exclusive right that is being infringed upon.

Note that we will send the person who is allegedly infringing your copyright with information about the notice and allow them to reply. If sufficient evidence of infringement is supplied, we may remove or suspend the reported content prior to obtaining a response from the user. If the allegedly infringing user provides us with a valid counter-notification showing that it is authorised to post the purportedly infringing content, we may notify you and replace the removed or disabled content. In such instances, we shall comply with the provisions of the Copyright Act, 1957, as amended by the Copyright (Amendment) Act of 2012, with a focus on the provisions germane to the digital era and other applicable laws.
You could be held liable for damages (including costs and attorney’s fees) under Section 65(A8) and (B) of the Copyright (Amendment Act) 2012, Copyright Act, 1957, if you willfully make a substantially false assertion that content or activity on the Website breaches your copyright.
COUNTER-NOTIFICATION PROCEDURES
You may file a counter-notification with us (a “Counter-Notice”) by sending written notification to our Copyright Claims agent (identified above). According to the copyright, the Counter-Notice must essentially include the following:
- Your signature, whether physical or electronic.
- A description of the content that has been removed or to which access has been disabled, as well as the location of the content prior to its removal or disablement.
- Provide sufficient information for us to contact you (including your name, postal address, telephone number and, if available, e-mail address).
- A declaration under penalty of perjury that you have a good faith belief that the material identified above was removed or disabled due to a mistake or misidentification of the material to be removed or disabled.
